Adoption Tax Credit for Special Needs
Adoptions Finalized between 2003 and 2009

Most families that adopted foster children who receive adoption assistance between 2005 and 2009, and a few who
adopted earlier, should be able to take advantage of the federal adoption tax credit, even if they had no expenses
related to the adoption. A new law and guidance have now made the tax credit refundable for the first time. [For non-special needs adoptions (except step-parent adoptions, which do not qualify for the credit), parents can claim
the credit with the same rules as below, except that they have to document qualified adoption expenses.]
